Terms of Service

1. Agreement to Terms

By accessing and using NorwayAbove, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.

NorwayAbove is a service operated by Gunstein Myre AS, org. no. 922 205 698, Kjøita 17, 4630 Kristiansand, Norway. In these Terms, "NorwayAbove", "we" and "us" refer to that company.

2. Description of Service

NorwayAbove is a curated library of authentic aerial footage from Norway. Drone operators (Contributors) grant NorwayAbove the right to license their work, and NorwayAbove licenses that footage to you in its own name. NorwayAbove is your counterparty for every purchase — responsible for the licence, the payment and the delivery. Our service includes:

• Access to a curated library of Norwegian aerial footage
• License management for purchased content
• Secure payment processing through Stripe
• Content delivery and download services
• Contributor upload and earnings management

3. User Accounts

3.1 Registration

You do not need to register before buying: an account is created for you when you pay, so you can return to your purchases and licence certificates. Contributors join by invitation. You agree to provide accurate, current, and complete information and to update it as needed.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must immediately notify us of any unauthorized use.

3.3 Account Types

• Buyer Accounts: For purchasing and licensing video content
• Contributor Accounts: For uploading and selling video content (by invitation)

4. Content Licensing

4.1 License Grant

Upon purchase, NorwayAbove grants you a non-exclusive, worldwide license to use the video content according to the license type purchased. Your agreement is with NorwayAbove alone; Contributors are not a party to it. License types include:

• Standard Licence: Use in your own channels, on paper too — website, social media, presentations, internal films, organic content and your own printed materials, such as brochures, annual reports, roll-ups and posters at your own premises or stand. Television, cinema and paid distribution require the Extended Licence.
• Extended Licence: Television, cinema and paid distribution — paid advertising including paid social, print advertising and other paid placements, paid campaigns and other paid distribution — plus everything the Standard Licence covers.

Both licences are perpetual, worldwide and non-exclusive, and require no attribution. You acquire a right of use, not ownership: copyright in the content stays with the Contributor.

Unusual, larger or exclusive licensing needs are not sold from the catalogue. An Exclusive Licence — where a clip is withheld from other buyers for an agreed period, territory or type of use — is priced on request, its scope is agreed individually, and it requires the rights holder’s explicit approval.

4.2 License Restrictions

Under either licence, you may not:

• Resell, redistribute, or sublicense the content as footage
• Use the content as a substantial part of a product for resale, including merchandise, templates and print-on-demand goods
• Register content with copyright offices
• Use content in a defamatory, pornographic, or illegal manner
• Use content to create a competing stock footage service

Under the Standard Licence you may additionally not use the content on television, in cinema, or in paid distribution of any kind, including paid advertising, paid social, print advertising and other paid placements, and paid campaigns. Your own printed materials are covered; printed products for resale are not, under either licence.

4.3 Attribution

Attribution is not required but appreciated. Contributors retain copyright to their original work and license it to NorwayAbove, which sublicenses it to you.

5. Purchases and Payments

5.1 Pricing

All prices are listed in Norwegian Kroner (NOK) unless otherwise stated. The licence price is the same whatever the clip’s native resolution, and every clip is delivered in that native resolution. Prices are subject to change without notice, but changes will not affect orders already placed.

5.2 Payment Processing

Payments are processed securely through Stripe. We do not store your credit card information on our servers. By making a purchase, you agree to Stripe's Terms of Service.

5.3 Refunds

Due to the nature of digital products, all sales are final once content is downloaded. Refunds may be granted at our discretion for:

• Technical issues preventing download
• Significantly mislabeled or misrepresented content
• Duplicate purchases made in error

Refund requests must be submitted within 7 days of purchase to support@norwayabove.com.

6. Contributor Terms

6.1 Content Submission

Contributors must own all rights to submitted content or have proper authorization to license it. By uploading content, you represent and warrant that:

• You own or have rights to all content submitted
• Content does not infringe on third-party rights
• You have obtained all necessary model releases and property permissions
• Content is authentic and filmed in Norway as represented
• Content meets our quality and technical standards

6.2 Content Review

All submitted content undergoes review before approval. We reserve the right to reject any content that:

• Fails quality standards
• Contains offensive or inappropriate material
• Infringes on rights of others
• Is improperly categorized or tagged
• Lacks required documentation (releases, permits)

6.3 Revenue Sharing

All contributors earn 50% of net licence revenue received by NorwayAbove, excluding VAT, after discounts including pack pricing, refunds and chargebacks. The rate is the same regardless of clip count, licence type or exclusivity. No tiers, no milestones, no conditional multipliers—just a transparent, consistent rate from your first approved clip onward.

6.4 Payouts

Earnings are settled quarterly by bank transfer within 30 days after quarter end. Amounts below NOK 500 roll over to the next settlement period.

6.5 Content Removal

Contributors may request content removal at any time. Removal does not affect licenses already granted to buyers.

7. Prohibited Activities

You may not:

• Violate any applicable laws or regulations
• Infringe intellectual property rights
• Upload malicious code or viruses
• Attempt to reverse engineer or circumvent security measures
• Use automated systems (bots, scrapers) without permission
• Manipulate or game the rating/review system
• Submit fraudulent content or claims
• Harass or abuse other users or staff

8. Intellectual Property

The NorwayAbove platform, including its design, features, and technology, is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works based on our platform.

9. Privacy and Data

Your use of NorwayAbove is also governed by our Privacy Policy. We collect and process personal data as described in that policy, which is incorporated into these Terms by reference.

10. Disclaimers

NorwayAbove is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the service will be uninterrupted, secure, or error-free. We are not responsible for:

• Accuracy of content metadata or descriptions
• Actions of contributors or buyers
• Technical issues beyond our control
• Third-party services (payment processors, hosting)

11. Limitation of Liability

To the maximum extent permitted by law, NorwayAbove and its operators shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless NorwayAbove from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any rights of another party
• Content you submit to the platform
• Your use of licensed content

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or platform notice. Continued use after changes constitutes acceptance of the new Terms.

14. Termination

We may suspend or terminate your account at our discretion for violations of these Terms. Upon termination:

• Your access to the platform will be revoked
• Previously granted licenses remain valid
• Earnings already accrued remain payable at the next quarterly settlement
• You must cease use of our platform and services

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of Norway, without regard to conflict of law principles.

15.2 Arbitration

Any disputes arising from these Terms or use of NorwayAbove shall be resolved through binding arbitration in Oslo, Norway, except where prohibited by law.

16. Miscellaneous

16.1 Entire Agreement

These Terms, along with our Privacy Policy and any additional guidelines, constitute the entire agreement between you and NorwayAbove.

16.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force.

16.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
